Terms of Service

These terms govern your use of poolcntrl.com and the poolcntrl iOS app (“the Service”). By creating an account or using the Service, you agree to these terms.
1. The Service
poolcntrl is a residential pool maintenance app. It calculates chemical dosing recommendations from water test data you provide, against pool parameters you configure. The recommendations come from a deterministic engine — not from AI guesses or human experts.
2. Your account
You’re responsible for keeping your account credentials secure and for any actions taken under your account. You must provide accurate information when you sign up. You must be at least 13 years old.
3. Subscription and billing
Paid plans are billed monthly via Stripe. Subscriptions auto-renew until you cancel. Cancellation takes effect at the end of your current billing period — we don’t prorate. You can cancel anytime in your account settings or, for App Store purchases, in your Apple ID subscription settings.
4. Refunds
We don’t offer refunds for partial months. If something genuinely went wrong on our end, email us — we’ll fix it. App Store purchases follow Apple’s refund policy.
5. Acceptable use
You won’t:
- Reverse-engineer, decompile, or attempt to extract the chemistry engine.
- Use the Service to provide commercial pool service to third parties under a competing brand.
- Abuse the API (rate-limit evasion, scraping at scale).
- Submit deliberately false or harmful data (e.g. to mislead another user).
6. Important: chemistry warnings
poolcntrl gives pool-maintenance recommendations, not chemistry safety training. You are responsible for handling chemicals safely:
- Read every product label. Follow manufacturer instructions, especially for chemicals that should never be mixed (chlorine + acid, for example).
- Wear gloves, eye protection, and appropriate clothing.
- Add chemicals to water — never water to concentrated chemicals.
- If a recommendation looks wildly different from what you’d expect, retest before adding anything.
- For commercial pools, public pools, or any pool where someone other than the owner swims regularly, consult a Certified Pool Operator (CPO) instead of relying solely on this app.
7. No professional advice
The recommendations are software-generated estimates for a residential context. They are not professional advice. We are not chemists, plumbers, water-treatment specialists, or doctors. If pool water causes illness or injury, seek medical attention; if pool equipment shows signs of failure, call a licensed pool professional.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE, NOR THAT THE RECOMMENDATIONS WILL ACHIEVE ANY SPECIFIC OUTCOME. ALL WARRANTIES, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE — ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $50 USD. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Termination
You can terminate your account at any time from within the app. We may terminate accounts that violate these terms, or suspend accounts during fraud or abuse investigations. On termination, your data is deleted per our Privacy Policy.
11. Changes to these terms
When we update these terms materially, we’ll bump the “Last updated” date and notify you by email. Continued use of the Service after the change date constitutes acceptance.
12. Governing law
These terms are governed by the laws of the United States and the state in which our principal place of business is located, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction.
